This website (“Site”) is operated by Candescent Health (the “Company”).  Our Privacy Policy is subject to change, so you are encouraged to revisit and review this Privacy Policy from time to time.  We will post any changes here, and any changes will become effective immediately upon being posted.

Please read this Privacy Policy carefully.  Your use of this Site indicates that you have read and accepted our privacy practices, as described in this Privacy Policy.  In addition, please review our Terms of Use, which govern your use of this Site.

Information That the Company Collects:

 

  1. Collection of Personal Information:

 

Personally Identifiable Information:   Personally identifiable information is information that identifies you or could reasonably be used to identify you personally (such as, but not limited to, your name, address, phone number, or e-mail address).  Providing personally identifiable information is voluntary.  You may, however, not be able to use the full functionality of this Site if you do not provide certain information. 

 

We collect personally identifiable information that you provide during your use of the Site, including:

    • information you provide when you sign up for any interactive aspects of our Site;
    • information collected when you contact us via online forms (providing feedback, support queries, requests for information, etc.) or offline methods (e.g., telephone).

 

  1. Collection of Technical Information:  This Site may also collect technical information regarding your computer and operating systems, such as your Internet Protocol address, domain name and system configurations and settings.

In order to collect the anonymous data described in the preceding paragraph, we may use temporary “cookies” that remain in the cookies file of your browser until the browser is closed.

The Company collects this information in four ways: directly from our web server logs, from the user, with cookies, and with web beacons or GIF files.

  1. Web Server Logs:

When you visit our Site we may track information to administer the Site and analyze its usage.

Examples of information we may track include:

  • Your Internet protocol address.
  • The kind of browser or computer you use.
  • Number of links you click within the Site.
  • State or country from which you accessed the Site.
  • Date and time of your visit.
  • Name of your Internet service provider.
  • Web page that linked you to our Site.
  • Pages you viewed on the Site.
  1. Use of Cookies

The Company may use cookies to personalize or enhance your user experience. A cookie is a small text file that is placed on your hard disk by a web page server. Cookies cannot be used to run programs or deliver viruses to your computer. Cookies are uniquely assigned to you, and can only be read by a web server in the domain that issued the cookie to you.

One of the primary purposes of cookies is to provide a convenience feature to save you time. For example, if you personalize a web page, or navigate within a site, a cookie helps the site to recall your specific information on subsequent visits. This simplifies the process of delivering relevant content and eases site navigation by saving your preferences and login information as well as providing personalized functionality.

The Company may share aggregated site statistics, but does not allow other companies to place cookies on our Site except to enhance or enable full use of the site. You have the ability to accept or decline cookies. Most web browsers automatically accept cookies, but you can usually modify your browser setting to decline cookies. Most Web browsers can be set to notify you when an HTML cookie is placed on your computer. You can manually delete HTML cookies and set most browsers to refuse to accept HTML cookies, although doing so may affect your website experience.  Likewise, most mobile devices allow you to disable the ability for geo-location information to be collected from your mobile device. The help function on most browsers and mobile devices contains instructions on how to set your browser to notify you before accepting cookies, disable cookies entirely, or disable the collection of geo-location data. You need to set each browser on each device you use to surf the Web. Thus, if you use multiple browsers (e.g., AOL, Safari, Internet Explorer, Firefox, etc.), you should repeat this procedure with each one. Similarly, if you connect to the Web from multiple devices (e.g., work and home), you need to set each browser on each device.  The IAB website at www.allaboutcookies.org tells you how to remove cookies from your browser. Further details are provided below about our cookie usage. 

If you reject cookies by changing your browser settings, then be aware that this may disable some of the functionality on our Site.

  1. Personal Information from Users

For some types of use related to the Site, we will ask for information such as your name, address, email, telephone number or facsimile number, and other information relevant to your use of the Site. You may also be asked to disclose personal information to us so that we can provide assistance and information to you. For example, we may need such information in order to provide online technical support and troubleshooting. We will not disclose personally identifiable information we collect from you to non-affiliated parties without your permission except to the extent necessary to provide the products and services, as described below.

  1. Use of Web Beacons or GIF files

The Site may contain electronic images known as web beacons – sometimes also called single-pixel gifs – that allow the Company to count users who have visited those pages and to deliver co-branded services. The Company may include web beacons in promotional email messages or newsletters in order to determine whether messages have been opened and acted upon.

Some of these web beacons may be placed by third party service providers to help determine the effectiveness of our advertising campaigns or email communications. These web beacons may be used by these service providers to place a persistent cookie on your computer. This allows the service provider to recognize your computer each time you visit certain pages or emails and compile anonymous information in relation to those page views, which in turn enables us and our service providers to learn which advertisements and emails bring you to our website and how you use the site. The Company prohibits web beacons from being used to collect or access your personal information.

How We Use, Share and Disclose Personal Information That We Collect via This Site

Any personal information you provide and the personalized data you create and save on the Site are used to provide services to you to inform you of products, services or opportunities that may be available through the Company. If you provide us with your name, address, telephone number and/or email address, or have done so in the past, the Company may contact you by telephone, mail and/or email. You may change your contact details or unsubscribe from mailing lists at any time by contacting us as provided below.

We do not rent, sell or share your personal information or personalized data to unaffiliated organizations except to provide products or services you have requested, when we have your permission or under certain limited circumstances. For example, we provide such information to companies who work on behalf of or with the Company, subject to confidentiality agreements. These companies may use your personal information to help the Company communicate with you about the Company’s services and services or to assist the Company in the provision of its products and services. We also use such information to respond to subpoenas, court orders or other similar legal obligations and process, comply with regulatory requests and audits, or to establish or exercise our legal rights or defend against legal claims. In addition, we will share such information if we believe it is necessary to do so in order to investigate, prevent or take action regarding illegal activities, suspected fraud, protect the interests, rights or property of the Company or others, in the event of violations of the Terms of Use, or as otherwise required by law. Finally, we may transfer information about you to any acquirer or successor of any of the affiliated companies if and to the extent that any of the affiliated companies is acquired by or merged with another company.

Information that the Company Does Not Collect

 

The Site is not directed at children and does not knowingly collect any personally identifiable information from children under thirteen (13) years of age unless the collection complies with the Children’s Online Privacy Protection Act (“COPPA”).  If you are under thirteen (13) years of age, do not send any information about yourself to us.  If we discover that a child under the age of 13 has provided us with personally identifiable information, we will use commercially reasonable efforts to delete that child’s personally identifiable information from its system.

 

Interactive Areas:

We may provide interactive areas that allow users to contribute content to the Site.  If you submit a question, comment, code, work of authorship, drawing, graphic, photograph or any other content to be published by us (either online or offline), you agree that we may publish your name or other personally identifiable information in connection with publishing the content.

Please review our restrictions on use and guidelines for interactive areas in our Terms of Use.  This Privacy Policy does not apply to any information you may disclose publicly in interactive areas.  You should keep in mind that whenever you post information about yourself to a Site, that information could be collected and used by people that you do not know.  In addition, certain interactive areas may display the message poster’s name and message.  We bear no responsibility for any action or policies of any third parties who collect any information that you may disclose in such public areas, if any, of this Site.

Your Choices Regarding Your Personally Identifiable Information:

 

You may access, review, update or request to delete your contact information and personal information by sending an email to our support attendant at: legal@candescenthealth.com.  Please include your first and last name and street address in your request. You may also update your information by calling or writing us using the contact information provided below. We will process your request in compliance with applicable laws and our policies and procedures. Please note that before we are able to provide you with any information or correct any inaccuracies we may ask you for additional information to verify your identity. 

Under certain circumstances we may be unable to provide access to all of your personal information, We may deny or restrict access or deny your request to change or delete your personal information for legally permissible reasons, such as situations where the information contains references to other individuals and is not reasonably severable or where it cannot be disclosed for legal, security, or commercial proprietary reasons. In addition, any opt-out choices may not apply where: (a) you make a specific request for information from us, or (b) we use your personally identifiable information for either operational purposes (e.g. to complete transactions requested by you, or to send you administrative communications either about your account with us or about features of our Site, including any future changes to this Privacy Policy, the Terms of Use, or any other policy or terms that affect you and your use of our Site). We will advise you of any reason for denying or restricting an access request to the extent permitted by law, rule or regulation. 

You should be aware that it is not always possible to completely remove or delete all of your information from our databases without some residual data because of backups and other reasons.

You may leave our Site by clicking on certain links on our Site.  Many of these links take you to Sites and online content that are not operated by us and are beyond our control.  If you “click” on these links, you will be taken to a third party website.  We have no control over, and is not responsible for, the content of any third party websites to which you link.  In addition, these other websites have their own privacy policies and practices that may differ from ours, and we encourage you to review the privacy policies of any other website you visit.

Security:

The Company takes reasonable steps to secure its systems and to secure your personally identifiable information on our systems, including limiting access to the personally identifiable information contained on our servers when processing your account transactions.  The Company maintains the information collected on servers located within the United States and does not transfer your data to other countries. Unfortunately, data transmissions over the Internet can not be guaranteed to be secure.  We make no warranty regarding the security of any information you transmit to us and you do so at your own risk.

Assignability:

We reserve the right to disclose, share, assign and/or otherwise transfer user information, including without limitation personally identifiable information, in connection with a merger, acquisition, consolidation, the sale of substantially all of its assets, or any other corporate change or restructuring, whatever form it may take.

 

Notice to Residents of California and Nevada

California law requires that we obtain your affirmative consent before we share your nonpublic personal information with non-affiliated third party companies. However, we do not currently share information about you with any non-affiliated third party that triggers this consent requirement. Accordingly, there is no need at this time for us to seek your consent or for you to take any action telling us not to share such information with non-affiliated third parties. 

In addition, if you are a California resident, California Civil Code Section 1798.83 permits you to request information regarding the disclosure of your personal information by the Company to its affiliates and/or third parties for their direct marketing purposes.
